Welcome to USA Party Store. These Terms of Service ("Terms") govern your access to and use of usapartystore.com (the "Site") and your purchase of products and services from USA Party Store ("USA Party Store," "we," "us," or "our"). Please read them carefully. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Who May Use the Site

You must be at least 18 years old, or using the Site under the supervision of a parent or guardian, to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method you provide.

Products, Pricing, and Availability

We work to describe and price our products accurately, but we do not warrant that product descriptions, colors, images, or other content are error-free. Balloon colors, printed colors, and custom items may vary slightly from what appears on your screen. All prices are in U.S. dollars and are subject to change without notice. Products are subject to availability, and we may limit quantities, discontinue items, or correct errors in pricing or descriptions at any time, including after an order has been submitted.

Orders and Payment

Your order is an offer to purchase. We may accept or decline any order, and we may cancel an order after it has been placed (for example, due to an error, suspected fraud, or unavailability). If we cancel an order you have paid for, we will issue a refund. Payment is processed by our third-party payment providers, and you agree to their terms in addition to ours.

Custom and Personalized Orders

Many of our products are custom-made or personalized using artwork, logos, photos, or text you provide. For these orders:

  • You are responsible for the accuracy of everything you submit, including spelling, dates, images, and design details. Please review your order and any proof carefully before approving it.
  • You represent that you own or have permission to use any logo, image, artwork, or content you submit, and that it does not infringe anyone's rights.
  • Because custom and personalized items are made specifically for you, they generally cannot be canceled once production begins and are not returnable except where an item is defective or we made an error. See our Return Policy for details.

Pickup, Shipping, and Delivery

We offer in-store pickup and local delivery in Marietta and the Metro Atlanta area, and shipping where available. Delivery windows, setup, and availability depend on your date, location, and order. Any delivery, setup, or shipping timeframes we provide are estimates and are not guaranteed. Please see our Shipping Policy and Delivery & Set Up information for more detail.

Returns and Refunds

Returns, exchanges, and refunds are governed by our Return Policy, which is incorporated into these Terms by reference. Please review it before purchasing, especially regarding custom, personalized, balloon, and final-sale items.

Event Room Rentals

Rentals of The Magnolia Event Room are subject to the separate Magnolia Room Rental Agreement, including its terms on deposits, cancellations, hours, and use of the space. Deposits and payments are governed by that agreement, which controls in the event of any conflict with these Terms as to event room rentals.

Intellectual Property

The Site and its content — including text, graphics, logos, and images owned by USA Party Store — are protected by intellectual property laws and may not be copied or used without our permission. Artwork and photos you submit for custom orders remain yours; you grant us a limited license to use them solely to produce your order and, unless you tell us otherwise, to show finished samples of our work.

Acceptable Use

You agree not to use the Site to break the law, infringe others' rights, submit false information, interfere with the Site's operation or security, or upload content that is unlawful, infringing, or offensive. We may refuse service, remove content, or cancel orders that violate these Terms.

Disclaimers

The Site and our products and services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, USA Party Store will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or our products or services. Our total liability for any claim will not exceed the amount you paid for the product or service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless USA Party Store and its owners, employees, and agents from any claims, losses, or expenses arising out of your violation of these Terms or your misuse of the Site, products, or services, including any content or artwork you submit.

Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or your use of the Site will be handled in the state or federal courts located in Georgia, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above and post the updated Terms on this page. Your continued use of the Site after an update means you accept the revised Terms.
